Booking Process
All bookings are subject to availability and confirmation. A booking is not confirmed until you receive written confirmation from us and the required deposit is paid.

You agree to provide accurate, current, and complete information during the booking process. You must notify us immediately of any changes to your contact information, emergency contacts, or health status.
Participant Conduct
You agree to conduct yourself responsibly during expeditions, follow guide instructions, respect local customs and environments, and not endanger yourself or others. We reserve the right to remove participants who violate these standards without refund.
Intellectual Property
Ownership of content and materials
Our Content
All content on our website, including text, images, logos, and expedition materials, is owned by Andes Adventure Visuals and protected by copyright laws. You may not reproduce, distribute, or create derivative works without written permission.
Your Content
If you share photos, reviews, or testimonials with us, you grant us a non-exclusive, worldwide license to use this content for marketing purposes. You retain ownership of your content.
Expedition Photography
Photos taken by our guides during expeditions may be used for marketing purposes. Participants who prefer not to be featured in promotional materials should notify us in writing.
Your Responsibilities
What we expect from participants
Physical Fitness
You are responsible for ensuring you meet the physical fitness requirements for your chosen expedition. We provide detailed fitness guidelines, and you must honestly assess your capabilities.
Health & Medical
You must disclose any medical conditions, allergies, or medications that could affect your participation. You are responsible for obtaining necessary vaccinations and medications, including altitude sickness prevention.
Travel Insurance
You are required to have comprehensive travel insurance covering medical expenses, emergency evacuation, trip cancellation, and adventure activities. Proof of insurance must be provided before departure.
Personal Equipment
You are responsible for bringing appropriate personal gear as specified in our equipment lists. We are not liable for lost, damaged, or inadequate personal equipment.
Limitation of Liability
Understanding risks and responsibilities
Assumption of Risk
Mountain expeditions and adventure photography involve inherent risks. By participating, you acknowledge and accept these risks, including but not limited to: altitude sickness, weather hazards, terrain challenges, wildlife encounters, and equipment failure.
Our Liability
Andes Adventure Visuals, its guides, and partners are not liable for: injuries or death resulting from participant negligence, pre-existing medical conditions, acts of nature or force majeure, third-party actions, or losses due to participant failure to follow instructions.
Maximum Liability
In no event shall our total liability exceed the amount paid for your expedition or workshop. This limitation applies to all claims, whether based on contract, negligence, or other legal theory.
Liability Waiver
All participants must sign a detailed liability waiver before departure. This waiver is a legally binding document that further defines risks and responsibilities.
Termination
When services may be terminated
Termination by You
You may cancel your booking according to our Cancellation Policy. Refunds, if applicable, will be processed as specified in that policy.
Termination by Us
We reserve the right to cancel an expedition due to insufficient bookings, safety concerns, force majeure, or other circumstances beyond our control. In such cases, you'll receive a full refund or credit toward a future expedition.
Participant Removal
We may remove a participant from an expedition without refund if they: violate these terms, endanger themselves or others, fail to follow guide instructions, or engage in illegal activities.
Governing Law & Disputes
Legal jurisdiction and dispute resolution
Jurisdiction
These terms are governed by the laws of Peru. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of Peruvian courts.
Dispute Resolution
We encourage resolving disputes informally by contacting us first. If informal resolution fails, disputes will be resolved through binding arbitration in Cusco, Peru, conducted in English or Spanish.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms of Service, together with our Privacy Policy and Cancellation Policy, constitute the entire agreement between you and Andes Adventure Visuals.
